The democratic exercise to elect the 18th West Bengal Legislative Assembly concluded in May 2026, marking the end of a high-stakes two-phase polling process. As the state moves toward a new administrative term, the process of forming the government follows a strict constitutional protocol and timeline.



Key Dates in the 2026 Election Timeline

The 2026 electoral process was condensed into a specific window to ensure a smooth transition before the current assembly's tenure expires on May 7, 2026.



  • Phase I Polling: April 23, 2026 (152 constituencies).



  • Phase II Polling: April 29, 2026 (142 constituencies).



  • Counting of Votes: May 4, 2026.



  • Final Result Declaration: May 4, 2026 (for 293 seats, with one seat pending re-poll in Falta).



  • Falta Re-poll: Scheduled for May 21, 2026, with results on May 24, 2026.



The Process of Government Formation

Once the Election Commission of India (ECI) notifies the final results, the formal process of government formation begins under the guidance of the Governor of West Bengal.



1. Reaching the Majority Mark

The West Bengal Legislative Assembly consists of 294 seats. To form a government, a party or a pre-poll alliance must secure a simple majority of 148 seats.



2. Resignation of the Incumbent Government

Before a new government can take office, the outgoing Chief Minister must meet the Governor to tender the resignation of the existing Council of Ministers. Typically, the Governor asks the outgoing administration to continue as a "caretaker government" until the new cabinet is sworn in.



3. Invitation by the Governor

The Governor, acting as the Constitutional Head under Articles 153 and 154, plays a pivotal role.



  • The party or alliance with the largest number of seats elects its Legislative Party Leader.



  • This leader meets the Governor to stake a claim to form the government, providing letters of support from elected MLAs.



  • If a clear majority exists, the Governor formally invites the leader to be sworn in as the Chief Minister.



4. The Swearing-In Ceremony

The Governor administers the Oath of Office and Secrecy to the Chief Minister-designate and the Council of Ministers. This ceremony officially marks the commencement of the new government's five-year term.



Post-Formation: The Floor Test

In instances where the majority is challenged or if it is a coalition government, the Governor may direct the new Chief Minister to prove their majority on the floor of the House. This is done through a "Motion of Confidence" during the first session of the new Assembly.
